A Data Protection Officer, or a DPO, is a qualified expert in data protection and data privacy, especially the EU’s General Data Protection Regulation (GDPR). Most larger companies and public bodies need a DPO. The DPO can be an employee of the company or organisation, an external consultant or the services of an external DPO-providing company can be used.
There are legal rules that determine whether a DPO must be appointed.
However, it is good practice for all organisations that deal with personal data to have a DPO or have access to an external DPO service.
GDPR: Companies and organisations that do not have a formal presence in the European Union (EU) but who offer goods and services to EU citizens or monitor their behaviour must appoint a European Representative who is based in the EU, to act as the data protection and GDPR point of contact for customers, users and the EU’s data protection regulators. This is a legal requirement.
NIS2: Companies and Organisations that provide critical infrastructure services, and other regulated companies and organisations, under the EU’s second Network and Information Security Directive (NIS2), and who have no establishment or settled presence in the EU, but target their services to the EU, must appoint a legal representative based in the EU. This is a legal requirement.
DSA: Companies or Organisations that are providers of intermediary services, under the EU’s Digital Services Act (DSA), and who have no establishment or settled presence in the EU, but target their services to the EU, must appoint a legal representative based in the EU. This is a legal requirement.
